Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets forth the principles that govern the use by customers of the servers, services and systems provided by WebOkay Internet Services. This AUP was not created in order to hinder the conduct of legitimate business activities, but rather to promote the integrity, security, reliability and privacy of our servers, services, systems and company as well as those of the companies whose Web Sites and E-Mail are trusted to our care.

The bottom line, as far as this AUP is concerned, is that if you are running a legitimate business we are quite certain that you'll be very happy with our service but that you'll also find that this AUP protects your business interests, as much as it does ours. On the other hand, if any of what follows is a concern to you, you can save us both a lot of time and trouble by taking your business elsewhere.

In addition to the other requirements of this AUP, Customers may only use WebOkay Internet Services' systems, services and products in a manner that, in WebOkay Internet Services' sole judgment, is consistent with the intended purposes of such systems, services and products.

If a customer is unsure whether a contemplated use or action is permitted, the customer should e-mail us with a description of the proposed use, at Policy@WebOkay.net for a determination as to whether the use is permissible. The examples identified in the subsections that follow are non-exclusive and are provided, in part, for guidance purposes.

WebOkay Internet Services reserves the right to refuse, suspend, or terminate service at any time.

WebOkay Internet Services does not host "adult", sites which contain "adult" orientated content or sites which engage in illegal activities of any nature. For the purpose of this policy, illegal activities include, but are certainly not limited to:

• Storing and/or distributing illegal copies of copyrighted software.

• Violating trademarks and copyrights.

• Violating U.S. Federal export laws.

• Selling and/or distributing illegal contraband.

• Posting, advertising, transmitting, re-transmitting or storing material on or through any of WebOkay Internet Services' system services or products that is in violation of any local, state, federal or non-United States law or regulation.

WebOkay Internet Services will terminate any account that engages in any form of Internet abuse, which includes, but is not limited to:

• Distribution of unsolicited Email (spamming), even in the event those unsolicited Email messages comply with the provisions of the Colorado Junk Email Law, is strictly prohibited . Our servers are physically located in the great State of Colorado thus we are legally bound to honor Colorado House Bill 00-1309, Article 25: The Colorado Junk Email law: 00-1309.pdf [22k].  The provisions of  the Colorado Junk Email Law provide us with immunity from civil liability for implementing anti-spam measures and it also provides for compensation from those who send unsolicited commercial email which is routed thru and/or sent via our network. In the event of a violation, said compensation will be pursued by WebOkay Internet Services, LLC to the fullest extent allowed.

• Distribution of mass E-mailing software/tools/systems.

• Attempting to circumvent user authentication or security of any host, network, or account on WebOkay Internet Services servers or the Internet at large ("cracking").

• Attempting, in any way, to interfere with or deny service to any user or any host on the Internet.

• Cross-posting messages to Usenet newsgroups.

• Using an account at another provider to promote a Web site hosted on a WebOkay Internet Services Server in an abusive manner

• Using a WebOkay Internet Services account to collect replies to messages sent from another provider which violate these rules or those of that provider.

• Mail bombing Internet users.

• Running packet sniffers or port scanners.

• Sending and/or relaying email through our servers for domain namess for which we do not provide primary DNS service.

WebOkay Internet Services will not accept or tolerate web sites on our servers which are dedicated to or contain content which promotes hatred of and/or discrimination against groups or individuals based on race, color, national or ethnic origin, religion, gender or disability. Any and all web sites found to be in violation of this Policy will be terminated immediately and without prior notification. Additionally, WebOkay Internet Services reserves the right to turn over any and all such material to relevant law enforcement and regulatory authorities both in the jurisdiction in which our servers reside and/or in the jurisdiction of the responsible client.

WebOkay Internet Services will terminate any account that engages in abuse of our servers, and/or our or our client sites. This abuse includes, but is not limited to:

• Excessive use of CPU resources.

• Attempting to gain access to the root account and/or other customers' accounts (hacking).

• Installing continuously running programs such as, but not limited to, IRC bots and chat servers.

• Reselling and/or remotely hosting for free or a fee of CGI scripts which are hosted on WebOkay Internet Services servers.

The customer is solely responsible or the content and/or the security of their web site.

The customer is responsible for maintaining a complete and current copy of their web site's content at a remote location. While WebOkay Internet Services does perform daily backups, these backups are intended for disaster recovery and should not be relied upon as being available for any other use.

WebOkay Internet Services has the right to delete all data, files, or other information in the customers web site account, if the customer's account with WebOkay Internet Services is terminated, for any reason, by either WebOkay Internet Services or the customer.

Should a violation of this user policy occur, the primary account holder will be held responsible for any damages to WebOkay Internet Services' business, service, equipment, network, operations, or reputation resulting from the user's actions including, but not limited to, government actions, vandalism, retaliation, and claims of libel, unfair competition, infringement of patent, copyright, trademark, service mark, or other intellectual property rights, violation of privacy, or other tort.

The use of WebOkay Internet Services' web hosting service is at the customers sole risk. Neither WebOkay Internet Services, its employees, affiliates, third party services, merchant licensors or the like, warrant that WebOkay Internet Services' web hosting service will not be interrupted or error free. While we will indeed make every good faith effort to ensure that our web servers are available to as many Internet users as possible and that there is minimal interruption of service as possible, under no circumstance will WebOkay Internet Services, its partners, its employees, or its affiliates be liable for any claims, any action either direct, indirect, special, incidental, or consequential, or any damages either punitive or alleged to have resulted, including loss of profits, from the use of or inability to use WebOkay Internet Services' service, from service interruptions, from customer errors or problems with their Internet connectivity, from unauthorized access to WebOkay Internet Services servers, from communication failure, from bandwidth congestion or interruptions, or from acts of G-d.

Accounts 30 days past due are terminated. A $25.00 fee, per domain/sub domain name, is charged to re-activate a past due account.

Any and all disputes shall be arbitrated and/or litigated in Pueblo, Colorado.
